CFTC Chair Mike Selig Pushes New Crypto Platform Rules

CFTC Chairman Mike Selig on Thursday said federal regulators are moving ahead with new crypto trading rules despite Congress failing to pass the CLARITY Act.

Stronger investor protections, regulated leverage trading and expanded Bitcoin (CRYPTO: BTC) adoption are some key areas of focus.

How CFTC Plans For Crypto Market Regulations

Speaking on the Coin Stories podcast, Selig outlined how the CFTC and SEC plan to establish crypto market regulations using their existing authority. The CFTC’s proposal would allow cryptocurrency exchanges to voluntarily register under federal oversight rather than relying solely on state money transmitter licenses.

It would also permit exchanges to offer margin trading to retail investors, an activity generally unavailable under existing state-based spot trading regimes.

    Registered platforms would face stricter requirements covering market manipulation, fraud prevention, customer fund segregation and trading surveillance.

    Selig noted that U.S.-regulated crypto derivatives exchanges currently offer leverage of around 7x or less, suggesting similar limits could apply to spot margin trading.

    The agency has opened a 60-day public comment period before advancing more detailed rules.

    "The president said market structure one way or the other with or without legislation," Selig said, adding that regulators would use their existing authority to deliver clarity.

    BTC Self-Custody Protected but Meme Coins?

    Selig emphasized that the CFTC does not intend to regulate individuals simply holding Bitcoin in private wallets or conducting transactions outside its jurisdiction.

    “We absolutely believe in the right to self-custody your assets and protect your own privacy in onchain transactions,” he said.

    Selig distinguished Bitcoin, Ethereum (CRYPTO: ETH) and Solana (CRYPTO: SOL) from meme coins, which regulators classify as digital collectibles under their interpretation.

    He warned that meme coins carry heightened manipulation risks because issuers may retain substantial token supplies and influence prices.

    The CFTC plans to incorporate those risks into its proposed token listing standards.

    BTC Collateral, Stablecoins, Tokenization in Focus

    Selig also outlined plans to expand Bitcoin’s role in TradFi markets.

    The CFTC already permits certain cryptocurrency assets to be posted as collateral through futures brokers and is exploring broader acceptance by clearinghouses and institutional swap dealers.

    He described Bitcoin as a store of value, with stablecoins providing liquidity without forcing investors to sell their holdings.

    While legislation could offer greater regulatory certainty, Selig believes well-designed agency rules could endure future administrations.
