Gensler Targeted Crypto to Win Warren’s Backing for Treasury Secretary, 'Crypto Dad' Chris Giancarlo Claims

Former CFTC Chairman Chris Giancarlo says for SEC Chair Gary Gensler targeted crypto to win support from Sen. Elizabeth Warren (D-Mass.) for a potential Treasury Secretary nomination.

Why Giancarlo Says Gensler Targeted Crypto

Giancarlo told the Bankless podcast that crypto wasn’t political until Sam Bankman-Fried’s collapse embarrassed Democrats who had taken his campaign contributions.

That embarrassment pushed Warren’s camp into attack mode rather than admitting any misstep, he said, and Gensler saw his path to Treasury Secretary running through earning her support by becoming crypto’s chief prosecutor.

Gensler used tactics including refusing to work with Congress on new legislation, debanking crypto companies and executives, declining to write clear rules, and abusing Wells notices to stop firms from operating without intent to prosecute them, Giancarlo said.

He called the overreach unprecedented, though he added the crackdown ultimately failed to stop the industry.

"Firms now that survived that period of time are emerging as some of the leading firms now," Giancarlo said.

Why Wall Street Banks Fueled the Resistance

Giancarlo argued American banks have spent 40 to 50 years lobbying against financial innovation, from interstate banking to chip-based credit cards to ATMs, and applied the same playbook against crypto.

He said bank lobbying groups convinced Warren that crypto posed an existential threat, and she fought the Clarity Act’s Senate passage as a result, even though banks will eventually need to adopt tokenized deposits regardless.

Why Giancarlo Expects the Entire Financial System to Go Digital

Giancarlo predicted the global financial system will fully transition to distributed ledger technology by 2040, pointing to the Depository Trust and Clearing Corporation’s collateral tokenization pilot, involving more than 50 major institutions, as early proof.

He compared Bitcoin (CRYPTO: BTC) futures approval at the CFTC in 2017 to laying the first railroad tracks, arguing regulators built institutional expertise with that first product that later supported:

  • Ethereum (CRYPTO: ETH) futures
  • XRP (CRYPTO: XRP) futures
  • Solana (CRYPTO: SOL) futures

He also criticized the GENIUS Act for importing Bank Secrecy Act surveillance provisions into stablecoin regulation, arguing the US risks losing its competitive edge in digital finance unless it rebalances law enforcement needs against financial privacy.

Moreover, Giancarlo called that balance the central theme of his new book, "The Quest for Financial Freedom."

On perpetual futures, Giancarlo said the CFTC won’t struggle regulating the instruments, since it already built expertise managing futures without fixed settlement dates back in the 1970s.

He credited current CFTC Chairman Mike Selig, whom Giancarlo mentored early in his career, with pushing perpetual futures trading onshore rather than offshore.
